Introduction and Acceptance of Terms of Service

Thank you for choosing Logivery! By using our products or services, whether on a free trial or as part of a subscription, you accept our terms and conditions, designed to ensure you have the best possible experience. We are happy to have you with us and are committed to providing maximum support for using our software.

Logivery is proudly created and managed by Logivery s.r.l., with registered office in Sant'Antonio Abate (NA), Italy. Our services and tools are created to simplify your business, and any updates or new features will automatically be included in these terms, so we invite you to check for updates.

In case of changes to the terms or service, we will always try to give you advance notice, but in any case, these updates will form an integral part of your contract with us. If at any time you have questions or need clarification about the terms, our team will be happy to help.

Registration and Your Account

When you register with Logivery, we ask you to provide accurate and up-to-date information about your business: this helps us offer you better service and adapt our solutions to your needs. Once registration is complete, as soon as your work environment has been activated, you will receive confirmation to start exploring everything Logivery has to offer.

To protect your account, we recommend keeping your login credentials secure. If you lose or suspect improper use of your password, we ask you to change it, and if you cannot, notify us immediately: we will create a new password so you can return to operations without worry.

After registration, you can choose which subscription to sign up for. The shipment count includes all shipments that have generated a shipping label or warehouse movement, whether created manually or derived from other shipments.

The Free Subscription

The Free plan is free forever, with no commitments or hidden costs. If you reach the maximum number of included shipments (200), you can continue using the service by activating our Trial subscription.

The Business Subscription

Compared to the Free plan, the Business plan allows you to manage a larger number of shipments, products, users, sales channels, and warehouses, along with advanced tools for post-sale marketing and faster support.

To activate the Business subscription, simply register a payment method on our secure Stripe gateway, which handles transactions for Logivery. The monthly fee will be charged at the beginning of each subscription period (monthly or annual), starting from the subscription date. At the end of each month, any additional shipments beyond the 500 included will be counted and charged to the same payment card.

The Trial Subscription

Try all Business plan features for free with our one-month Trial subscription, which includes unlimited shipments. When the trial ends, you can choose to:

  • Stop using Logivery
  • Continue with the Free plan
  • Upgrade to the Business plan

The choice is entirely yours and should be based on what works best for your business.

The Enterprise Subscription

Compared to the Business plan, the Enterprise plan is designed for clients seeking completely customized solutions. Services and prices are defined together through tailored contracts, designed to offer maximum support and perfectly adapt to your company's specific requirements.

Billing and Refund Policy

The service is invoiced at the time of payment and does not provide refunds for partially used months of service. However, in the event of early termination of the annual subscription, Logivery will refund the months not yet used, calculating the difference between the amount paid and the cost of the months already used at the full monthly price, excluding any discounts previously applied.

Subscription fees are automatically charged every month or year, depending on the chosen plan, and will continue until you cancel your subscription.

Account Modification, Downgrade, and Cancellation

If you decide to downgrade, consider that some features and content may no longer be available, and Logivery cannot be responsible for any loss of data or tools connected to this change. You can request cancellation of an ongoing subscription directly from your user area: if you have a paid account, the fee will no longer be charged from the following month.

If subscription renewal is not completed, which includes the online request and payment of the relative fee, the system will automatically proceed with service deactivation. Additionally, after 15 days of the subscription period expiration, data related to service configuration and shipments, including all associated data, will be deleted.

Logivery reserves the right to suspend or terminate your account and access to services for any reason. In case of suspension or termination, your subscription will be canceled.

The cancellation of the account can be explicitly requested by its owner by writing a request to [email protected]. The request will be processed within 72 hours.

Service and Price Changes

Logivery may, without notice, modify, remove, or temporarily or permanently suspend any service feature to ensure you always have an updated and efficient platform. Similarly, we might update monthly subscription prices based on new features or improvements.

Interaction with External Services

Our Services may include links to carriers, websites, or third-party services that we do not own or manage. It's important to know that the inclusion of these delivery options does not mean we endorse or are affiliated with the mentioned carriers or services.

When you interact with a carrier or third-party service, for example to make payments or receive deliveries, the responsibility for such actions is yours. Logivery cannot be held responsible for any errors, omissions, or problems arising from these interactions.

If you access websites or use third-party services through our platform, such as carriers, marketplaces, or other connected services, you acknowledge the risks that may arise. Keep in mind that each external service may have its own policies, and you are responsible for complying with them.

By using our Services, you release Logivery from any liability arising from the use of such third-party services or websites. We are always here to support you, but we encourage you to be careful when interacting with external services.

Data Analysis and Service Proposals

To offer increasingly effective support, Logivery analyzes platform usage data, collecting information about your logistics needs, such as warehouse management and shipping. This analysis allows us to better understand your business's specific needs and formulate non-binding proposals that include targeted logistics services, such as warehouse management solutions, optimized shipping, and other ancillary services.

Proposals are processed through advanced technologies, including artificial intelligence, with automatic or semi-automatic processes. These suggestions are not binding and will be communicated to you through various channels, such as email, support tickets, chat, or voice interactions. You can always freely evaluate received proposals and decide whether to accept, ignore, or reject them without any obligation.

Service Level Agreement (SLA)

Service availability (SLA) in a given period is defined as the percentage of time the system can deliver the service for which it was previously configured.

The downtime period begins when Logivery's technical support receives a report from the customer regarding a blocking issue, through a traceable communication channel, and ends when the service is fully restored.

Logivery provides the following SLAs calculated on an annual basis, with a minimum reference period of 30 days, based on the history of the relationship:

  • Target SLA: 99,50%
  • Minimum SLA: 98,00%

In case of failure to meet the minimum SLA, the customer is entitled to contract termination with a refund of the unused portion of the fee until expiration, or, alternatively, to the generation of credit equal to 10 times the downtime experienced during the contractual duration.

In case of failure to meet the target SLA, the customer is entitled to credit equal to 5 times the downtime experienced during the contractual duration.

The credit will be usable exclusively for the use of the Logivery platform.

The following causes are excluded from the calculation of unavailability times:

  • errors in environment configuration (except when such configurations were explicitly commissioned to Logivery with a specific project);
  • changes in platform conditions outside the compatibility limits stated in the service documentation;
  • unavailability of external data and services (e.g., marketplaces, warehouses, and carriers) imposed by counterparties on Logivery or the Logivery service user;

Data Warranty and Liability

Logivery commits to ensuring secure data custody and minimizing the risk of errors in transmission, alteration, or other anomalous situations. However, it is not responsible for damages arising from unforeseen events or events beyond its control. In case of anomalies, Logivery will collaborate with the customer to promptly resolve problems, as provided for in the contract.

Advertising

Logivery reserves the right to mention your company as a customer, including the possibility of citing it on our website, in advertising communications, or other forms of marketing, while respecting the commitment to sensitive data confidentiality. Your company may be named as a reference, to inform other customers or for promotional purposes. In any case, such use will be limited to general information about service provision, without disclosing confidential or sensitive details.
